McLaren/Alex Palou trial begins

The dispute between McLaren and four-time IndyCar champion Alex Palou, which began in 2022, is about to be resolved, with a trial beginning in London this Monday before the Commercial Court.

It's a multi-episode saga that should soon reach its conclusion. On July 12, 2022, Chip Ganassi Racing announced the contract extension of champion Alex Palou. IndyCar title, for the 2023 season. Less than four hours later, the Catalan denied the information, indicating that he had informed Ganassi of his desire to no longer drive for the team from 2023. Five minutes after this tweet, the team McLaren confirmed the arrival of the Spaniard the following season.

An initial legal action was then brought by Ganassi against its driver, before the three parties involved reached an amicable solution. Palou would continue to drive for Ganassi in 2023, while serving as McLaren's reserve driver in Formula 1 in several Grand Prix, before joining the Woking team in 2024.

Calm returned from that moment until August 12, 2023. While on the verge of a second IndyCar title, Alex Palou informed Zak Brown that he would not be joining his team in 2024! A violation of a previously signed contract prompted McLaren to sue Palou, both in the United States and England. While the first complaint was settled amicably, the second is still ongoing, leading to the trial that began this Monday.

Alex Palou has now appeared before the London Commercial Court in a case in which McLaren is claiming $25 million from him for breach of contract, as well as reimbursement for various lost revenues from sponsors and car manufacturers, as well as reimbursement of a $400,000 bonus paid to Alex Palou. While the Spanish driver and his lawyers are not contesting the breach of contract, they believe the amounts advanced by Zak Brown's teams are disproportionate.

During this first week of the trial, both sides will present their arguments to the court. During the second week, McLaren and Palou will be able to call "experts" to the stand. These are, for "expert testimony regarding driver engagement/remuneration, commercial sponsorship, and the exploitation of other commercial opportunities," Julian Jokobi, a veteran driver manager, and Brian Marks, an experienced executive in the field of commercial operations. They are defined as "IndyCar experts." Their F1 counterparts are former team principals Otmar Szafnauer and Claire Williams.

Normally, the third week of the trial would be used by the court to analyze all the evidence presented by both sides and their experts, with a verdict delivered in the third week. According to Racer.com, the London Commercial Court will not be able to rule on this trial so soon due to other pending cases. The judge will therefore return to the McLaren/Palou trial later this year, with a verdict likely to be delivered in November, December, or even early 2026.
